Fort Lauderdale Motorcycle Accident Attorneys

For 2014, The Insurance Institute for Highway Safety (IIHS) reports that 4,295 motorcyclists died as a result of accidents. This means that, for 2014, 13% of deaths experienced by motor vehicle crashes were caused by motorcycle accidents.

According to the National Highway Traffic Safety Administration (NHTSA), in a traffic accident, motorcyclists are more than 30 times more likely to die and more than 5 times more likely to be injured than people in cars.

Florida is no exception to these sobering statistics. In 2012, one in five traffic fatalities in Florida was a motorcycle death; 491 people died in Florida in 2014 in a motorcycle accident – more than any other state’s motorcycle fatalities.

Such statistics are a reality in Florida because it is consistently ranked as one of the top three states regarding the number of registered road bikes. In 2014, 558,123 motorcycles were registered in Florida, second only to California in the nation’s bike count. The number of people – both residents and tourists – who enjoy traveling by bike in Florida makes the probability of accidents high.

Causes of motorcycle accidents

As with all any kind of motorized vehicle accident, negligence is a common cause for motorcycle accidents. We at GMV Law Group are prepared to assist motorcycle drivers and passages who are injured due to negligence, such as:

  • Reckless driving – speeding, sudden lane changes, or sudden turns
  • Drunk under the influence of alcohol or drugs
  • Distracted driving – texting, talking on the phone, talking to other passengers, using a navigation system, using the radio or a media player
  • Manufacturing or design defects of motorcycles or motorbikes
  • Failure of awareness – drivers of motor vehicles such as cars, trucks, and SUVs not seeing or looking for smaller motorcycles on the road
  • Manufacturing or design defects of motorcycles or motorbikes

Helmets and Head Injuries

While Florida law requires all motorcycle riders to have eye protection (such as a windshield, goggles, or glasses), the majority of drivers do not have to wear helmets. The law states that drivers who are older than 21 years of age and who carry an insurance policy with a minimum of $10,000 are not required to wear a helmet. This law, however, has consequences. The fatality rate for motorbike accidents increased by almost 50%, according to the National Center for Biotechnology Information, when Florida changed this law to no longer require adult moped and motorcycle riders to wear helmets.

Motorcycles are by nature unprotected. An accident that might cause minor injuries to a driver or passenger in an enclosed motorized, larger vehicle can prove fatal to a motorcyclist. While wearing a helmet significantly reduces the risk of brain injuries for riders, when a bike collides with a car, the rider is at an extreme disadvantage and the likelihood of significant injury is still high.
